| Order of the Ministry of Health, by which specific and temporary measures are adopted for the containment of the regrowth of COVID-19 appeared in the municipality of Totana | Royal Decree-Law 21/2020, of June 9, on urgent prevention, containment and coordination measures to face the health crisis caused by COVID-19, established a series of measures and general guidelines for prevention, containment and coordination to face the sanitary crisis, once phase III of the Plan for the Transition towards a New Normality has been overcome and the validity of the declaration of the state of alarm has ended.Through an Agreement of June 19, 2020, the Governing Council approves the prevention and containment measures applicable in the Region of Murcia to deal with the health crisis situation caused by COVID-19, after the end of the state of alarm and for the reactivation phase.

Subsequently, this Agreement has been modified twice on July 9 and 13, due to epidemiological developments.For the proper development of the provisions herein and in order to guarantee compliance with the general measures it contains, the third additional provision of Decree-Law 7/2020, of June 18, on measures to revitalize and reactivate the regional economy on the occasion of the health crisis (COVID-19), specifically empowers the person holding the Ministry responsible for health, as a health authority, to modulate or modify, in accordance with applicable regulations and in view of developments of the health situation, by Order, the general hygiene and prevention measures and those related to the capacity and the maximum number of people allowed for each type of establishment, facility or activity, approved by agreement of the Governing Council.It is also empowered to adopt those additional or complementary measures to those provided in said Agreement that it is necessary to implement, on a temporary basis and for as long as it is necessary, such as, perimeter confinement, isolation, quarantine, restrictions on collective mobility, general suspension of activities, closure or closure of facilities, applicable to specific sectors of activity or to specific territorial areas in the event of localized outbreaks.closure or closure of facilities, applicable to specific sectors of activity or to specific territorial areas in the event of localized outbreaks.closure or closure of facilities, applicable to specific sectors of activity or to specific territorial areas in the event of localized outbreaks.By the competent services of the General Directorate of Public Health and Addictions, a report has been issued dated July 23, 2020, which highlights the inescapable need to urgently adopt intense containment measures in the municipality of Totana to cut the outbreak.

that had its origin in the contagions of the last weekends of July, mostly linked to the closed spaces of pubs and discotheques, and which led to the adoption of restrictive measures in night-time leisure activities, and avoiding transmission community.Consequently, to prevent as far as possible the uncontrolled expansion of COVID-19 in the municipality of Totana and its extension outside it, it is necessary to adopt preventive measures that affect mobility and circulation between this and other municipalities, thus as well as the full development of various activities that, due to their characteristics, can favor the spread of the virus.To this end, among other measures, capacity and maximum occupancy limits are reduced, setting the number of people who can gather in both public and private spaces to carry out private or unregulated activities at ten.Likewise, the activity of hotels, restaurants and nightlife, discotheques and the like inside the premises is suspended, and these activities can only be carried out on terraces, for which the general limitation of fifty percent of the capacity will also govern, and whose hours Closing at night is brought forward at 00.00.In accordance with the provisions of article 11.1 of the Statute of Autonomy, approved by Organic Law 4/1982, of June 9, the Region of Murcia is attributed with the competence of legislative development and execution in matters of health, hygiene, pharmaceutical management and hospital coordination in general, including Social Security, without prejudice to the provisions of number 16 of article 149.1 of the Constitution, the Ministry of Health being the department of the Autonomous Community of the Region of Murcia responsible for the proposal, development and execution of the general guidelines of the Governing Council in the aforementioned matters, by virtue of article 11 of the President's Decree 29/2019, of July 31, reorganizing the Regional Administration.By virtue of this, in use of the powers conferred by the third additional provision of Decree-Law 7/2020, of June 18, on measures to revitalize and reactivate the regional economy due to the health crisis (COVID-19), at the proposal of the Director General of Public Health and AddictionsI have:Article 1.

Purpose.It is the object of this order to establish the set of exceptional and urgent measures to face the unfavorable evolution of the epidemic of COVID-19 produced in the last days in the municipality of Totana.Article 2.

Measures to restrict the freedom of movement of people.2.1.

The free entry and exit of people from the territorial scope of the areas affected by this order is restricted from the time of its official publication.2.2.

Notwithstanding the foregoing, those trips, properly justified, that occur for any of the following reasons will be allowed:- Assistance to health centers, services and establishments.- Compliance with labor, professional or business obligations.- Return to the place of habitual residence.- Assistance and care for the elderly, minors, dependents, people with disabilities or especially vulnerable people.- Due to force majeure or a situation of need.- Any other activity of a similar nature.2.3.

The circulation on highways and roads that pass or cross the territory of the affected area will be allowed, as long as it has its origin and destination outside it.2.4.

The movement of residents within the affected municipality is allowed, although displacement and non-essential activities are discouraged.Article 3.

General measures of hygiene, prevention and capacity.3.1.

Compliance with the general measures of hygiene, prevention and capacity provided for in Section I of the annex to the Agreement of June 19, 2020 of the Governing Council regarding prevention and containment measures applicable in the Region of Murcia to deal with the health crisis situation caused by COVID-19, after the end of the alarm state and for the reactivation phase.3.2.

La participación en cualquier agrupación o reunión de carácter privado o no regulado se limita a un número máximo de 10 personas, tenga lugar tanto en espacios públicos como privados, excepto en el caso de personas convivientes.Artículo 4.

Medidas específicas aplicables a los sectores de actividad regulados en el Apartado II del anexo del Acuerdo de 19 de junio de 2020, de Consejo de Gobierno.4.1.

En el ámbito del municipio afectado se suspende la aplicación de las medidas específicas de contención y aforo aplicables a cada sector, previstas en el Apartado II del citado anexo del Acuerdo de 19 de junio de 2020 del Consejo de Gobierno, en todo lo que se oponga a lo dispuesto en el presente artículo.4.2.

Con carácter general, la ocupación máxima permitida de los establecimientos, locales o instalaciones previstas en el citado Apartado II, se fija en un cincuenta por ciento de su aforo.Esta restricción será de aplicación tanto en el interior de sus locales, cuando su uso esté permitido, como en sus espacios al aire libre o terrazas.4.3.

Los límites máximos de ocupación, asistencia o participación previstos para cada una de las actividades recogidas en el Apartado II del Acuerdo, quedan reducidos a la mitad de lo dispuesto en cada supuesto.

En todo caso, las actividades realizadas por grupos estarán sujetas al límite máximo de diez personas fijado en el artículo anterior.4.4.

Queda suspendida la posibilidad de ampliar el límite máximo de ocupación, asistencia o participación, previa elaboración de planes de actuación específicos, a que se refiere el citado Apartado II.4.5.

Queda suspendida la actividad de hostelería, restauración, pubs, ocio nocturno, discotecas y juego y apuestas en el interior de los locales, pudiendo estos desarrollar únicamente su actividad en terrazas o espacios abiertos al aire libre.4.6.

La hora máxima de cierre nocturno de establecimientos de hostelería, restauración, pubs, locales de ocio nocturno, discotecas y locales de juego y apuestas queda fijada en las 00.00 horas, no pudiendo admitirse nuevos clientes a partir de las 23.30.Artículo 5.

Aplicación de las medidas adoptadas.

Auxilio judicial.5.1 Los ciudadanos deberán colaborar activamente en el cumplimiento de las medidas previstas en esta Orden.5.2.

En todo caso, los incumplimientos individualizados de lo dispuesto en la presente orden podrán constituir infracción administrativa de conformidad con lo dispuesto en el Decreto Ley 8/2020, de 16 de julio, por el que se establece el régimen sancionador por el incumplimiento de las medidas de prevención y contención aplicables en la Región de Murcia para afrontar la situación de crisis sanitaria ocasionada por el COVID-19 y demás normativa aplicablo.

Las fuerzas y cuerpos de seguridad darán traslado de las denuncias que formulen por el incumplimiento de las medidas de prevención a las autoridades competentes.Artículo 6.

Vigilancia y control de las medidas adoptadas.

Cooperación y colaboración entre Administraciones Públicas.6.1 El seguimiento y control de las medidas adoptadas se desarrollará en el marco del Plan Territorial de Protección Civil de la Región de Murcia (PLATEMUR), instándose su reactivación y la elevación del nivel de emergencia que corresponda.6.2.

La vigilancia, inspección y control del cumplimiento de las medidas de restricción y prevención recogidas en esta Orden corresponderá a las autoridades estatales, autonómicas y locales competentes, según el régimen de distribución competencial previsto en la normativa aplicable.6.3 Se dará traslado de la presente Orden a la Delegación del Gobierno, al Ayuntamiento de Totana y a los ayuntamientos limítrofes, a los efectos de recabar su cooperación y colaboración, en su caso, a través de los cuerpos y fuerzas de seguridad y de la policía local, para el control y aplicación de las medidas adoptadas.Artículo 7.

Ratificación judicial.Por el conducto reglamentario adecuado se solicitará, asimismo, la ratificación judicial de las medidas contempladas de conformidad a lo dispuesto en el artículo 8.6 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa.Artículo 8.

Eficacia.La presente Orden entrará en vigor el mismo día de su publicación en el Boletín Oficial de la Región de Murcia, y tendrá una vigencia inicial de siete días, a contar desde las 00:00 horas del día de su publicación.Esta vigencia podrá ser prorrogada si así lo requiere la evolución de la situación epidemiológica.Murcia, a 23 de julio de 2020.
