From the SOMOS SINDICALISTAS Union in the Region of Murcia, we appreciate the personal empathy and the closeness and the dialogue spirit of Mr.

Jose Vļæ½lez, in the interview this morning as well as the exquisite treatment of the workers of the Government Delegation. We have been able to state that public, temporary and labor workers in fraud of law due to Temporality do not feel represented by the Majority Unions, that they have negotiated for them and that they will be part of the legislative solution to their situation ½n, this being a movement from the bottom up, which has been organized around Somos Sindicalistas and other organizations in worker platforms here in the Region of Murcia, and in the rest of Spain, so they must be consulted and be part of the solution to your group. Apart from the forms, there are obvious points of disagreement, in the applicable legislation when the Government Delegate told us, the importance that they give to the recent cassation judgments of the Supreme Court, and what our Union Delegate said that these Judgments have been issued without transposing the European Directives, directives that are of mandatory transposition and compliance after their publication, and that the judgments of the European Court and applicable Directives are supra-national and have a higher rank than those of the member state, as the competence in justice is a shared competence with the European Union. There are also conflicting points regarding the scope of the legislative modification of the EBEP in the making, arguing by the representative of the Government in the Region of Murcia, that said modification cannot invade the different competences transferred to the Autonomous Communities, and Local Administrations, although it is clear that a certain level of recommendation of the State legislation, an extreme that is in contrast to the position of our union that believes that said modification should establish effective measures and effective, that root out the fraud of the law in the temporality, as well as the stability of the abused personnel, which includes the Proposition not of Law approved by a large majority, including the parties in the Government in which urges the Government of Spain to modify the EBEP,and that this modification should be binding on all Administrations ļæ½ since failure to do so could generate unfair comparative grievances depending on the Administration to which the abused personnel belong. There are also meeting points regarding the incidence of personnel with abuse of temporary employment, in the different administrations, with high rates in the Autonomous Communities and Universities, being important in the City Councils especially those with the largest population , with the lowest incidence corresponding to the State Administration, what is completely coincident is the positions of the imperative need to reduce the temporality in public administrations although the solutions proposed by the collective collide with how they are ½n executing the selection processes for the positions of abused personnel even though a legislative reform is in the making, and in the middle of a pandemic. We have sent you the manifesto that has been read in the collective concentrations throughout Spain, where the claims and solutions proposed by the affected group are collected (Attached to this statement), and we appreciate the commitment to make it reach Government of Spain. We understand that the short time available has not been able to debate and speak in depth about all the issues that involve a legislative amendment of such complexity and importance, leaving a long way to go, to bring such distant positions closer together, although it is evident that the Participation of the affected group would enrich and give the resulting text the necessary vision of some workers who have their rights and that we at Somos Sindicalistas are willing to defend.
