From the Municipal People's Group we are very clear that we Spaniards must stop being complex and be more human and therefore we must defend the Permanent Reviewable Prison, and we will do so during the celebration of the plenary that will be held on Thursday, January 25 at the City Council of Totana.

The Organic Law 1/2015, of March 30, which modifies the Organic Law 10/1995, of November 23, of the Penal Code, which entered into force on July 1, 2015, introduced into our legislation the prison permanent revisable.

It is an instrument that exists in many countries around us, in governments of all types of political courts;

it is a coherent institution, which is well incorporated into our guarantee model and has a perfect criminal record.

The reviewable permanent prison, clearly stated in the Statement of Motives of this Law, does not renounce the reintegration of the convicted person, because once a minimum part of the sentence has been served, "a Tribunal must assess again the circumstances of the convicted and the crime committed and You can review your personal situation. "

The forecast of this periodic judicial review of the prisoner's personal situation, ideal to be able to verify in each case the necessary favorable prognosis of social reinsertion, says the Statement of Motives, "removes all doubt of inhumanity of this penalty, by guaranteeing a horizon of freedom for the condemned. "

Once the minimum time of the sentence has been served, "if the Court considers that the necessary requirements do not exist for the prisoner to be able to regain his liberty, a period will be established to carry out a new review of his situation; On the contrary, the Court considers that it meets the necessary requirements to be released, a conditional freedom period will be established in which conditions and control measures will be imposed, aimed at guaranteeing the safety of society, as well as assisting the prisoner in this phase end of his social reintegration. "

It adds the Statement of Motives that "the reviewable permanent prison sentence does not constitute, therefore, a sort of" final penalty "in which the State disregards the prisoner, on the contrary, it is an institution that makes compatible the existence of a criminal response adjusted to the severity of the guilt, with the purpose of re-education to which the execution of prison sentences must be directed ".

Despite all this, several parliamentary groups filed an appeal for unconstitutionality, an appeal that the Constitutional Court admitted for processing in July 2015. Admission to proceedings does not imply any ruling on the merits of the case, although some seek the repeal of this measure without wait for the pronouncement of the Constitutional Court.

Thus, on October 4, 2016, the Plenary Session of the Congress of Deputies debated and approved by a majority of the Basque Parliamentary Groups (EAJ-PNV), Socialist, Republican Esquerra, Confederal of Unidos Podemos-En Comú Podem-En Tide, Mixed and the abstention of Citizens, and only with the vote against the Popular Parliamentary Group, the Proposition no of Law for the Repeal of the Punishment of Permanent Revisionable Prison.

And more recently, on November 10, a Proposed Law Modifying Organic Law 10/1995 of the Penal Code (Organic Law), which seeks to repeal the permanent remainable prison and that had the only vote against, has been accepted. of the Popular Group.

After these events and actions, there are many citizens who have expressed their support for the penalty of permanent prison reviewable as a means to ensure the safety, rights and freedoms of all Spaniards.
